These terms describe how email and text messaging may be used through CDL Smart App. They supplement the Terms of Service and Privacy Policy.
Consent and responsibility
CDL Smart App customers may use messaging features only when they have a lawful basis and any consent required for the message being sent. Customers are responsible for the content, audience, purpose, timing, and legality of messages they initiate through their workspace.
For text messaging, a customer must confirm that the recipient has expressly agreed to receive the applicable messages before the platform will queue the message. A customer may not falsely record consent or create fabricated consent evidence.
Text-message disclosures
Message frequency may vary. Message and data rates may apply. Consent to receive text messages is not a condition of creating a free CDL Smart App driver profile or purchasing a paid CDL Smart App subscription.
Recipients can reply STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to supported text conversations to request that further messages stop. Recipients may reply HELP for basic help information. Where a recipient uses another reasonable method to withdraw consent, the sender must honor that request as required by law.
Marketing versus transactional messages
Account, security, application, billing, service, or employment-related messages may be treated differently from promotional messages under applicable law. Customers must not label a promotional message as transactional to avoid consent or opt-out requirements.
Commercial marketing email must include the disclosures and opt-out method required by applicable law. Customers sending their own commercial email through or in connection with CDL Smart App remain responsible for sender identification, accurate subject lines and headers, required postal-address information, and honoring unsubscribe requests.
Opt-out handling
CDL Smart App may automatically record supported SMS opt-out keywords and prevent additional queued text messages to an opted-out destination for the applicable organization. Customers remain responsible for honoring revocations received by other reasonable channels, including phone, email, or direct communication, when the law requires them to do so.
Prohibited messaging
Users may not send unlawful telemarketing, deceptive content, harassment, threats, discriminatory recruiting messages, phishing, malware, misleading sender information, messages to people who have opted out, or communications that violate carrier, messaging-provider, industry, or government rules.
Third-party carriers and delivery
Delivery depends on mobile carriers, email providers, and third-party messaging infrastructure. Delivery is not guaranteed, and filtering, blocking, delay, or nondelivery may occur outside CDL Smart App's control.
