Notice at Collection: This notice is provided at or before CDL Smart App collects applicant information through its driver-profile and application workflows. It describes the categories of personal information that may be collected, why the information is used, how long it may be retained, and the choices that may apply. It supplements the general Privacy Policy.
Motor carriers, recruiting agencies, staffing companies, and other organizations using CDL Smart App may be separate businesses or controllers of applicant information. They are responsible for any employer-specific privacy notice, Notice at Collection, employment disclosure, or authorization that law requires them to provide. This notice does not replace an organization's own notice.
Categories of applicant information
Depending on the application, CDL Smart App may process identifiers and contact information; address history; Social Security number; date of birth; driver-license and CDL information; endorsements and credential expiration dates; DOT medical-card information; employment and unemployment history; education and training; military service information supplied by the applicant; commercial-driving experience; accident and motor-vehicle violation history; safety and FMCSR/MVR responses; application certifications and electronic signatures; documents the applicant chooses to upload; communication preferences; and application activity.
Purposes
We process applicant information to let drivers create and maintain reusable profiles, complete commercial-driver applications, submit applications to selected organizations, provide application PDFs and records, support authorized recruiting workflows, identify missing or inconsistent application information, maintain security and audit records, respond to privacy requests, and comply with applicable legal obligations.
Sensitive information
Social Security numbers and driver-license numbers are treated as sensitive identity information and are subject to additional storage and access protections. Sensitive identity values are kept separately from ordinary saved application data where supported by the platform's secure profile architecture. Authorized organizations may receive sensitive information only through workflows designed for lawful application or compliance purposes and subject to applicable permissions and redaction settings.
We do not use sensitive applicant information to infer characteristics for advertising, and we do not sell or share applicant information for cross-context behavioral advertising or targeted advertising.
Criminal history and background reports
CDL Smart App's universal driver profile does not request general criminal-history information. An employer may have separate rights and obligations regarding criminal-history questions, timing, background reports, fair-chance laws, and adverse-action procedures.
CDL Smart App does not treat the universal application as an employer's stand-alone authorization to obtain a consumer report, investigative consumer report, FMCSA PSP report, Clearinghouse query, or drug/alcohol test. Where such an authorization is required, the requesting organization is responsible for presenting and retaining the legally required employer-specific form and process.
Safety-performance investigations
When an application is submitted to a motor carrier, federal motor-carrier rules may require the carrier to investigate certain prior-employer safety-performance information and provide drivers with related rights. The motor carrier, not CDL Smart App, is responsible for completing those required investigations and notices.
Technology-assisted review
Technology may help extract, organize, proofread, or flag application information. CDL Smart App does not make employment decisions or automatically determine whether a person should be hired or rejected. Authorized organizations remain responsible for lawful human review and for ensuring that employment decisions comply with applicable anti-discrimination, disability, privacy, fair-chance, and employment laws.
Sharing and disclosure
Applicant information may be disclosed to an organization selected through an application or sharing workflow, to vendors that process information on our behalf to operate the service, and as otherwise described in the Privacy Policy. We do not sell applicant personal information for money or use applicant information for targeted advertising or cross-context behavioral advertising.
Retention criteria
CDL Smart App retains applicant information only for as long as reasonably needed to provide the requested profile and application features, maintain security and audit records, comply with law, resolve disputes, enforce agreements, and support requested application activity. In setting retention periods, we consider account status, whether information remains needed for an active workflow, the sensitivity and volume of the information, backup cycles, fraud and security needs, legal claims, and applicable recordkeeping duties.
An employer or carrier that receives an application may have independent federal, state, or business record-retention duties and may lawfully retain its copy after a driver deletes a CDL Smart App account. CDL Smart App cannot delete a copy independently controlled by another organization.
Applicant rights and requests
Applicants may update saved profile information and may submit a request to access, correct, obtain a portable copy of, or delete CDL Smart App account data. Depending on applicable law and circumstances, additional rights may apply, including rights concerning sensitive-data processing, profiling, or appeals. We may verify identity before processing a request. Requests concerning an employer's independently retained records may need to be directed to that employer.
Requests may be submitted through the Privacy Requests page or by emailing support@cdlsmartapp.com. We will not unlawfully discriminate against a person for exercising an applicable privacy right.
California notice
For California residents, the categories above describe the applicant information CDL Smart App may collect and the business purposes for which it is used. We do not sell applicant personal information or share it for cross-context behavioral advertising. Sensitive personal information is used for purposes reasonably necessary to provide and secure the requested service and related lawful employment workflows.
An employer or recruiting organization using CDL Smart App may have its own California Notice at Collection obligations and must provide any notice required of that organization at or before collection.
